Decision of the National People's Congress on Revising the Criminal Procedure Law of the People's Republic of China

The National People’s Congress has recently passed a number of important to the Criminal Procedure Law of the People’s Republic of China.
 
One amendment relates to torture and states that no one can be obliged to confirm their guilt in an interrogation which amounts to torture. Clear and definite procedures have been introduced to ensure the effective exclusion of any evidence obtained as a result of torture.
 
Additional important amendments relate to the provision of legal aid to various groups of suspects; the provision of legal aid has been extended to those persons who are mentally impaired and those accused of committing offences punishable by life imprisonment , if they are not yet to instruct a defence lawyer.
 
Further amendments to the Criminal Procedure Law include providing a new procedure for a review of the verdicts of those convicted of capital offences and a clearer explanation of the criminal investigation procedures. This includes changes to ensure that meetings between the defendant/suspect and their lawyer shall not be monitored. It is also stated that for those convicted under the age of 18, their criminal records shall be sealed off and remain confidential.
